1. GENERAL PROVISIONS

We inform you that any personal data you provide through this website will be processed by SOLÉ & MARTÍNEZ ADVOCATS, S.L. (hereinafter, “S&M ADVOCATS”) in its capacity as data controller. S&M ADVOCATS, owner of this website, is domiciled at C/ Prat de la Creu 59-65, esc. D, 5a planta – AD500 – Andorra la Vella (Principality of Andorra), registered in the Register of Companies of the Principality of Andorra under number 20117 and the Register of Commerce and Industry of the Principality of Andorra under number 925925 C, with tax registration number L-715210-V. S&M ADVOCATS informs you that for any question related to the protection of your personal data, you can contact our Data Protection Officer, in accordance with the provisions of letter b) of section 3 of this privacy policy.

Contact and electronic contracting of services offered through this website for S&M ADVOCATS may only be carried out by persons over 18 years of age. Accordingly, if you provide your personal data through this website, you do so under the presumption that you are over 18 years of age. In the event that S&M ADVOCATS ascertains that personal data has been provided by a person under the age of 18, S&M ADVOCATS will delete the data.

Personal data of third parties other than the data subject may not be provided via this website. However, in the event that it is essential to carry out the request for services that justifies the provision of the personal data of a third party, the person who does so assumes responsibility for previously informing the holder of the personal data of all that is provided for in Article 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter, “GDPR”) under the conditions set out in the aforementioned regulation.

In the event that, in order to properly carry out a request for services, you must provide personal data of minors under 18 years of age, you guarantee S&M ADVOCATS that you do so in your capacity as father, mother or legal guardian of the minor holder of the personal data, also granting your express consent for the processing of the same. In this case, you have to prove the relationship or guardianship, by providing an official document, for example, a scanned copy of the family book.

 

2. FILE DECLARED IN ACCORDANCE WITH ANDORRAN LEGISLATION TO THE ANDORRAN DATA PROTECTION AGENCY (hereinafter “APDA”)

In compliance with the provisions of Law 15/2003 of 18 December 2003 on the Protection of Personal Data (hereinafter “LQDP”) and the regulations that develop it, users of this website are informed that any personal data provided to S&M ADVOCATS will become part of a file owned by S&M ADVOCATS, duly registered with the APDA.

4. PURPOSE AND LEGAL BASIS OF THE PROCESSING AND PERIOD OF RETENTION OF PERSONAL DATA

S&M ADVOCATS may process your personal data for the purposes described below:

a) Through the form that S&M ADVOCATS makes available on this website to contact us, S&M ADVOCATS will collect and process your personal data in order to manage your request, and will carry out all the formalities and / or procedures necessary to process it.

b) The legal basis for this processing of personal data is the consent that you must give by ticking the box “I have read and accept the privacy policy”, which appears on the communication form that S&M ADVOCATS makes available on this website. The provision of your personal data through this form is therefore voluntary, but if you do not provide it, we will not be able to process your request. This consent may be revoked at any time, although such revocation will make it impossible to continue processing your request, query or complaint.

c) S&M ADVOCATS will keep your personal data for the maximum periods that, in accordance with current legislation, are applicable and, in any case, for the maximum period that is necessary for the intended purpose of its processing.

 

5. RECIPIENTS OF THE PERSONAL DATA, INCLUDING SERVICE PROVIDERS

S&M ADVOCATS will provide the following personal data to third parties:

• name and surname of the person concerned,
• e-mail address,
• and telephone number.

The purpose of the transmission of data is exclusively the booking of an online meeting with our law firm for the purpose of requesting a possible service.

S&M ADVOCATS provides you with the various links to the privacy policies of the service providers to whom your personal data will be transmitted in case of booking an online meeting with our office.

All other personal data provided to S&M ADVOCATS will not be passed on to any third party, except when S&M ADVOCATS is required to do so:

a) comply with the requirements of any applicable law or other lawful regulation, legal process or enforceable governmental requirement.

b) enforce the terms and conditions of service purchased, including investigation of possible violations.

c) detect, prevent or otherwise address fraud, security or technical problems.

d) to hand them over to the competent public administration, in the cases provided for by law and for the purposes defined therein.

 

6. RIGHTS IN RELATION TO YOUR PERSONAL DATA

On the one hand, in compliance with the LQPD and the implementing regulations, S&M ADVOCATS informs you that in order to exercise your rights of access, rectification, deletion and opposition of your personal data, recognised in said regulations, you must send a written and signed communication to the address indicated in section 1 of this privacy policy, to which you must attach a copy of your passport or other national identification document.

On the other hand, in accordance with the RGPD, if you are in the European Union, you have the right to obtain confirmation as to whether or not S&M ADVOCATS is processing personal data concerning you, to access your personal data, as well as to request the rectification of inaccurate data or, where appropriate, request their deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected. Under the conditions provided for in the GDPR, data subjects may also request the limitation of the processing of their personal data or their portability, in which case S&M ADVOCATS will only retain them for the exercise or defence of possible claims.
